These Terms and Conditions govern your use of the QOMMS mobile application, website, and related services. By using QOMMS, you agree to these Terms.

You must be at least 18 years old or have legal parental or guardian consent where applicable. You are responsible for ensuring compliance with local laws.

Accounts may only be created through the official QOMMS mobile application. The website does not support account registration. Users are responsible for maintaining the confidentiality of their login credentials.

QOMMS Premium is offered as:

• Professional Plan
• USD $10 per month
• Automatically renewing
• Cancel anytime
• Access remains active until the end of the paid billing period unless otherwise stated

Subscription payments are processed securely through authorized payment providers. Users authorize recurring monthly billing until cancellation. Failed payments may result in suspension of Premium access.

Users may cancel their subscription at any time. Cancellation prevents future renewals. Previously paid subscription fees are generally non-refundable except where required by applicable law.

Except where required by law:

• Subscription payments are non-refundable.
• Partial-month refunds are not provided.
• Service interruptions caused by factors outside QOMMS' reasonable control do not automatically entitle users to refunds.

QOMMS grants users a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial aviation training. No ownership rights are transferred.

Users agree not to:

• Reverse engineer the application
• Modify the software
• Share accounts
• Circumvent subscription restrictions
• Upload malicious software
• Attempt unauthorized access
• Interfere with platform operation
• Use the platform for unlawful purposes

All content, software, trademarks, logos, graphics, training materials, AI evaluation systems, and source code are owned by QOMMS or its licensors. No content may be reproduced without written permission.

QOMMS is an educational aviation communication platform. AI-generated evaluations are intended solely for training purposes and should not be considered official aviation instruction, regulatory guidance, or a substitute for certified flight instruction. Users remain responsible for complying with all applicable aviation regulations and instructions from air traffic control.

We strive to provide uninterrupted service but do not guarantee continuous availability. Maintenance, updates, outages, or third-party service interruptions may temporarily affect availability.

To the fullest extent permitted by applicable law, QOMMS, its affiliates, officers, employees, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of the Services. Where liability cannot be excluded, it shall be limited to the amount paid by the user for the Services during the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless QOMMS and its affiliates from any claims, damages, liabilities, costs, or expenses arising from your misuse of the Services or violation of these Terms.

We may suspend or terminate accounts for:

• Fraudulent activity
• Violation of these Terms
• Abuse of the platform
• Security concerns
• Illegal activity

These Terms shall be governed by and construed in accordance with the laws of the State designated by QOMMS, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located within that jurisdiction, unless applicable law provides otherwise.

We may modify these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
